Brands can self-certify, third-party certifications vary in their standards, and the term itself has no legal definition in most markets. A product can be marketed as cruelty-free in ways that are technically accurate but practically misleading.
Here's what rigorous cruelty-free actually looks like: no animal testing at any stage of the supply chain — not on finished products, not on raw ingredients, not by third parties contracted by the brand, and not in markets where animal testing is legally required for import. That last point is where a lot of brands run into trouble. Selling in mainland China, for example, has historically required animal testing, which is why "cruelty-free except in China" isn't really cruelty-free.
